The family is in hopes that bringing me home will wake me up and get me moving again. Tammy, Cheri, Jaye, and mom were there. It seemed to go ok. There are a few things that need to be done before they can come to the house and say that I can come home. Jaye and Cheri need to get trained on helping take care of me in case it is needed. I am waiting for the "Judge" to approve the paperwork that got sent to her. Brad Stramm came and picked up the paperwork to begin with. We don't know why. No one hired this man, he just showed up one day. These lawyers are just looking for money. I want to go home. Every time someone mentions going home, I just light up.&lt;br /&gt;*My family is getting things ready so I can come home. The house is going well.&lt;br /&gt;*My older brother's friend Rodney has been coming and doing reflexology on me. It has really helped out. My right arm which wouldn't budge at all, was straightened out in ONE session!! Why don't more medical center embrace this kind of healing?&lt;br /&gt;*The doctors did a scan on my right lung. They don't know if it is an infection or scarring tissue from the chest tubes. If they didn't the hospital threatened that they would sign me out of the hospital AMA (against medical advice). Floor 5 of the hospital is disgusting. There is no way I am getting moved to floor 5. Apparently this all has to do with bills from the hospital and Medicare won't pay because the HOSPITAL keeps messing paperwork up. Makes you wonder. This apparently started because of several factors:&lt;br /&gt;1) With the increased intake of food, and having diarrhea, my anti-seizure medicine was not being absorbed&lt;br /&gt;2)The clinicians were not monitoring my level of anti-seizure medicine to ensure that it was still there and working. The neurologist said they should be checking this weekly to make sure that it is still effective in nature and things like this do not happen.&lt;br /&gt;*I have gained 15 pounds as a result of them upping my intake of food. I was emaciated due to the clinicians not feeding me according to weight and height. The hospital has not changed my catheter in a long time. As a result I was peeing blood. Urology does not want the catheter to come out, but the rest of the staff has not done the rest of their part by trying to make sure that this does not happen. This has happened before because they refuse to change the catheter on a regular basis. Luckily my mother was there to catch this. When can the neglect finally stop?&lt;br /&gt;*My sister Cheri and my brother Kenny have a meeting with Leigh Anderson tomorrow to go over the financial papers so they have control over my finances. This may help me get out of ECMC and speed up the process. Let's hope.&lt;br /&gt;*My mother got a hold of Kaleida and they are looking into taking me. I cannot leave a hospital setting yet, but this might be a better place than ECMC. ECMC keeps lying to other facilities about my level of care so that these facilities do not want to take me as a patient. We don't know exactly why they are doing this. Among the things that were discussed:&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family: trebuchet ms;"&gt;       -My weight is below (well below) what it should be for a 6'2'' man. Currently I weigh approximately 117 pounds. I came into the hospital weighing in at about 160. My sister Tammy came with information about proper weight, calorie intake and fluid flushes and what they should be. The doctors said this will be addressed and hopefully I will get the food I need to gain weight back on me which in turn will help me gain strength to keep fighting.&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family: trebuchet ms;"&gt;       -Respiratory therapy came and did tests on me. They showed the family as well as myself some exercises to do to try to gain back some lung capacity. There have been plenty of lung infections as I have one now.&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family: trebuchet ms;"&gt;        -Respiratory therapy wrote orders to downsize my trach and plug it for a trial period to watch my O2 levels. (Since this meeting, they have done so and I am doing better with the trach being plugged than when it wasn't. My O2 levels have gone up and you can hear me trying to talk)&lt;/span&gt;&lt;br /&gt;&lt;/span&gt;&lt;span style="font-size:100%;"&gt;&lt;span style="font-family:trebuchet ms;"&gt;          &lt;/span&gt;&lt;span style="font-family: trebuchet ms;font-family:trebuchet ms;" &gt;-Speech, Occupational, Physical, and range of motion therapy are to come in to assess what level of care I can receive to gain muscle mass and mobility back.&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family: trebuchet ms;font-size:100%;" &gt;&lt;br /&gt;        &lt;span&gt;-Urology is to be in to do tests to see if I can go to the bathroom on my own instead of having a catheter. The catheter just causes urinary track infections anyway because they never change it.&lt;/span&gt;&lt;br /&gt;           &lt;span&gt;-I am to be taken out of bed 2-3 times a day. I cannot leave the floor however, but getting out of bed is good.&lt;/span&gt;&lt;br /&gt;&lt;span&gt;        -The nurse practitioner that has been a problem has been removed from my case because she has been a problem to the family since she has been on the case.&lt;/span&gt;&lt;br /&gt;&lt;span&gt;        -There is going to be another meeting in a month or so to continue discussing my care and where to go from here.&lt;br /&gt;&lt;br /&gt;*Hopefully this will help, but it can't undo what this hospital had done to myself and my family. From past experience however, the hospital tends to say one thing to appease the family and not follow through with what they say. It wasn't as bad as Joan Warren had made it out to my uncle.&lt;br /&gt;*I have been getting very angry with a lot of people lately. No one quite knows why.&lt;br /&gt;*The hospital yelled at my mom and took my wheelchair away. Why? Because they thought my mother was feeding me. Come to find out, they found applesauce and a spoon in my bed. It was from one of the other staff members trying to do a swallow test on me. My brother, my guardian, told them if they have a problem with my mother to not take it out on me. This is very true because this is what they have been doing all along. They get mad at my mother and abuse me as a result. We are waiting for this to happen so guardianship gets turned over for the temporary period.&lt;br /&gt;*In the meantime, getting a hold of the "old" guardian to get a hold of paperwork for my bills and financial situation has been hell. Just as before, she will not return phone calls so we may have to try to get a hold of someone who will make her do this. Is she this incompetent? Suspicions arise that she may do so to say that the family is not capable of handling guardianship. We shall see.&lt;br /&gt;*I was very mad at my mother the other day. Being able to not communicate very well, I was able to show it very well regardless. The family couldn't figure out why I was mad however. I was trying to talk and was moving up a storm however. This is a good sign. The court finally turned over guardianship of me to my sister Cheri and my brother Kenny. This is a temporary thing for 90 days to see if it works out. There is a lot to be done and a lot to go over as far as my care goes. Paperwork as well. Hopefully my family can do this. Court was not easy though. This is good for me, but my mother doesn't think so because she wants control over the situation. My mother is worried about Cheri's husband, Dan, because my mother feels that in the past Dan has shaped and influenced too much of Cheri's decisions. This may be true, but we don't know for sure. Either way, Cheri is there and cares about me and that is what is important. Well hopefully the family can work this out. If Cheri didn't show up, the case would still be going on. Of course the judge still has to rule on this tomorrow. My mother can bitch all she wants but at least I have a guardian in the family if the judge rules with the court evaluator and not Leigh Anderson. My mother and my sister will have to learn to work with each other and talk and listen. This may be the hand of god stepping in to say now is the time to clear things up. Who knows. Everything happens for a reason.&lt;br /&gt;*On another note, I have water on my knee for some reason. My knee was about the size of a grapefruit till they had someone come down and drain it. My mother asked about if they were going to do anything for it. The nurse she asked just said, "I guess we will have to amputate his knee."  ~as a side note, I, Jaye, wonder if they said that with Fuzzy there. The lawyer talked to all of them and then the court evaluator talked to each of the family members, one by one. First Tammy went, then Kenny, Cheri then Jaye. The evaluators each had a set of questions they wanted to ask each of them. "Your father has alzheimers?" "What if you and your mother did not agree on the care for your brother, what would you do?" "Have you ever been arrested?" "Would you have a problem moving out if your mother told you you had to?" These questions were nerve wracking, but they all got through them.&lt;br /&gt;*The family has to go back on the 16th to get a final judge's ruling on who should be the guardian over me and my care/assets etc.&lt;br /&gt;&lt;br /&gt;*Today is my sister Jaye's birthday. They have me on a new medicine to see if it helps. Everyone showed up-Tammy, Kenny, Cheri, Jaye and mom. They had called the lawyer that is supposed to be representing my mother a few minutes before a "court clerk" came out to tell them the case was being adjourned till January (2nd or 3rd). This was just a little before two o'clock. Mind you when they called my mom's lawyer, his assistant informed them that "He was on his way that everyone was running late, but he should be there shortly." The court however was informed way before this time that the lawyers were not showing up at all. My brother tried to speak on everyone's behalf stating that everyone has tried to get in contact with the lawyers but it is very difficult because no one calls back or acknowledges that they are there. He said this in response to Judge Sconiers stating that they (my family) needs to get in contact with the lawyers to make sure they inform them (my family) of when court is and is not happening. Other than this, they had no room to talk. The family is going to be doing a bit more digging on this and write some more letters. This is ridiculous. How can a guardianship case take A YEAR to figure out. A YEAR. In the meantime, I lay in the hospital bed because my so called "guardian" (Leigh Anderson) doesn't care about me and lets me lay there. She don't see the progress I have made and don't care to know either way. No one out there to help my family win back guardianship over a very corrupt system?  Please God send someone our way....&lt;br /&gt;*Here are some court cases that might be of some interest:&lt;br /&gt;&lt;br /&gt;Matter of Nasquan S., 2 A.D.3d 531 (2nd Dept.)&lt;br /&gt;Petitioner was the AIP’s mother. She sought to be appointed guardian and to have the attorney&lt;br /&gt;appointed as co-guardian. The trial court refused to appoint the attorney as co-guardian and&lt;br /&gt;instead appointed a third party stranger. I was trying to talk quite a bit. I moved my arm and my legs. I was drooling when she came in. She told me to keep doing my tongue exercises that it might help.&lt;br /&gt;*I had a hard time breathing. The nurse came in and said that I needed to be suctioned because my O2 levels were at 76. My temperature was 99.2. They suctioned me and my O2 levels went back up to 94 at 40% oxygen. Apparently a lot of mucous came out.&lt;br /&gt;*After being suctioned I was mad and tired. So I really didn't try talking to anyone after that.&lt;br /&gt;*The infection doctor came in to examine me. She seemed alright but who knows with that hospital.&lt;br /&gt;*There is an employee at the hospital that had a family member go through the ping-pong fiasco that we have gone through between them and the nursing home. The employee said she is quite upset because she thought she would be treated better because she is an employee there. As a result the employee's relative has to go to dialysis three times a week. They want my family to look into getting ECMC into the brand new home in Chautauqua county. The state said they are a better facility.&lt;br /&gt;*The hospital had me listed as mentally retarded which is not the case. They cannot, and have not assessed me to say such a thing.&lt;br /&gt;*The hospital also has me listed as not being able to sit in a wheel chair. This is also not correct. I can hold my own head up and sit without sliding out of the chair.&lt;br /&gt;*The state also said we should get a hold of Neighborhood Legal Services to try and win this case against the guardian whom of which is not doing her job at all. Enjoy:&lt;br /&gt;&lt;br /&gt; &lt;p class="MsoNormal" style="line-height: 200%;"&gt;&lt;span style="font-size: 11pt; line-height: 200%;"&gt;To Whom It May Concern:&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="line-height: 200%;"&gt;&lt;span style="font-size: 11pt; line-height: 200%;"&gt;I have sat back and watched what the hospital (&lt;st1:place st="on"&gt;&lt;st1:placename st="on"&gt;Erie&lt;/st1:PlaceName&gt; &lt;st1:placetype st="on"&gt;County&lt;/st1:PlaceType&gt;  &lt;st1:placename st="on"&gt;Medical&lt;/st1:PlaceName&gt; &lt;st1:placetype st="on"&gt;Center&lt;/st1:PlaceType&gt;&lt;/st1:place&gt;) and the lawyers on the guardianship case have done to my brother, Frederick Lascelles Jr. and I am appalled. Personally, I feel that it may be the case where the hospital has lied to the lawyers about things and the lawyers let go on, go on. They are not there every day, but my mother is along with numerous other people who go to see my brother. This is not even including the nurses who see him every single day. Even so, how can some one deemed his guardian let this happen. &lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="line-height: 200%;"&gt;&lt;span style="font-size: 11pt; line-height: 200%;"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="line-height: 200%;"&gt;&lt;span style="font-size: 11pt; line-height: 200%;"&gt;I will give you an example. Yesterday, it was Halloween, October 31, 2007. I get to the nursing home that he got sent to on a whim. I went to bring him a pumpkin that he wanted. I arrive at the Erie County Home (&lt;st1:city st="on"&gt;Erie&lt;/st1:City&gt; County Medical Center’s other nursing home besides the one they have directly inside the hospital) in &lt;st1:place st="on"&gt;&lt;st1:city st="on"&gt;Alden&lt;/st1:City&gt;, &lt;st1:state st="on"&gt;New York&lt;/st1:State&gt;&lt;/st1:place&gt;. I am told by a nurse there that my brother has a severe lung infection and needs to get sent back to ECMC because they do not have the medicine to treat his infection. It is resistant to many drugs and only the hospital has the medicine to take care of it. That’s great I think, because he had been running a temperature of around 103-104 degrees. The nursing home doesn’t have the cooling blankets to bring down his temperature anyway. I have taken several college courses in Microbiology and things of this sort. So, when I was informed today, November 1, 2007, that he was getting sent back to the nursing home in Alden I was shocked. There is no way on the face of the planet that a severe lung infection that is resistant to common antibiotics can be cleared up over night. I was also informed by my mother who talked to an undisclosed nurse the night that my brother came into ECMC of October 31 that the social worker there that night had informed the nurse it didn’t matter what happened, he was getting sent back to the nursing home. The social worker did not inform my mother of this. It upset the nurse so bad she went home crying. &lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="line-height: 200%;"&gt;&lt;span style="font-size: 11pt; line-height: 200%;"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="line-height: 200%;"&gt;&lt;span style="font-size: 11pt; line-height: 200%;"&gt;How can this be right in any aspect? What happened to the ethical part of the medical profession? Have we gotten so far deep into the bottom line that we can’t even take care of a young man who can’t take care of him self? The hospital doesn’t care about clearing up something that would take ten days at the most so instead they just ship him back to the nursing home to get sent back to the hospital in a few days anyway? Is this ping-pong that they are playing with my brother? The Hippocratic Oath states: “I will keep them from harm and injustice.” This I feel is very harmful to my brother what is going on. You cannot start to treat a condition with antibiotics or get shipped every 24 hours as they have done to him. He is supposed to be in critical care and they are doing this to him? You start to treat some one with antibiotics you do not just stop. The infection will become resistant to the antibiotics that way. What in the world are these people doing and what game do they think they are playing? I have had enough of this and want something done about this and not tomorrow or the day after, but right now. Something should have been done a long time ago. It should not have gone this far. My mother was informed by an undisclosed nurse at the facility that a social worker commented about moving me back to the Nursing home today irregardless of the fact that the infection that I have is not gone and will take a while to get rid of because the infection is resistant to many common drugs. The hospital does not care, they just want me and my family out of ECMC. Which, would happen if they stopped playing stupid mind games with all of us. Are they slow or something? The nurse tried to get an explanation out of the social worker as to why she didn't just inform my mother. The social worker just turned and walked away without answering the nurse. You can check out my MySpace page to see what it looks like.&lt;br /&gt;*They informed me, my sister Jaye and my mother that I have to be transported back to ECMC because I have a lung infection that the nursing home can't take care of. They do not have the medicines at the nursing home for such things. Plus I have a temperature that has been consistently above 100 degrees. They do not have cooling beds/blankets at the nursing home. My MOTHER had to make it come down with ice chips, but it is still high at 99 degrees. Therapists...</title><content type='html'>*The physical therapist (Debra Bernier) from ECMC's nursing home in Alden, NY decided to pay a visit to my mother. She told my mother that because I had been in the hospital like this for over a year that they had decided to not do any kind of rehab on me whatsoever. That maybe they would do range-of-motion on me but that would be about it.&lt;br /&gt;*My mother received a call from her lawyer explaining that we needed to get everyone from the family to go to court on December 2, 2007. They want to get rid of this case, including Leigh Anderson and hand over guardianship to the family again. Apparently the letters and calls we have been making is making a difference. She also sent out letters to the Attorney General-Civil rights bureau and the health care bureau.&lt;br /&gt;*Yesterday my big brother Ken received a call from Ziegler. This man explained to him that they are trying to work things out and get me out to Lake Shore Hospital while working with the nation to help to get me better. He also informed my brother that if Leigh Anderson does not cooperate with us then there will be further investigation.&lt;br /&gt;*Today I have 103 fever. The nursing home where I am informed my mother that I may have to go back to the hospital (ECMC) because I am worse than they had been told by ECMC.&lt;br /&gt;*I have no tv in my room where I am now.&lt;br /&gt;*The nursing home wanted my family to bring clothes and bar soap in for me. This should be done through my guardian.&lt;br /&gt;*Today Ken went to see Joan Warren regarding the custody battle over me.&lt;br /&gt;*My sister Tammy sent out for guardianship papers through social services to try to get guardianship back to the family. She has also yet to inform the family members that I was going to be moved and where. Family members were informed by other lawyers. This shows a blatant disregard for the family members and lack of responsibility on her part.
